Recently, our HR department pushed down a new over time policy to bring us closer to the Fair Labor Standards Act (FLSA) - where Time and a Half Over Time (OT) kicks in after 40 hours worked.
They gave us a provision for snow events - when the district is closed on a "Code Red" - no employees report unless directed to by their supervisor for snow removal operations. Then it's automatically the time and a half rate.
The problem we ran into this year was snow events that happened on a Friday or over the weekend. No code reds were announced, and HR stated that the guys clearing the schools got "straight" time up to their 40 hours worked before 1.5 kicked in, because a code red wasn't announced.
We're working on pushing back, and trying to get an exception in the policy for any emergency work that would be required to make sure that a building is open and operational for the next school day.
My question - how do you guys handle emergencies and overtime?
